An Enduring Power of Attorney is a legal document that appoints someone to make financial or medical decisions on your behalf if you are unable to, or choose not to. By appointing someone under an Enduring Power of Attorney you are ensuring your care is in the hands of trusted person or entity.

There are various types of Powers of Attorney that may be relevant for you:

WHO SHOULD YOU APPOINT?


Whilst many people appoint a family member or friend to act as their Attorney, it’s important to consider whether they are the best people to manage your affairs.

  • Are they unbiased?
  • Do they have the required skills?
  • Do they have the time?
  • Are they committed to always acting in your best interests?
  • Are you confident they can manage your affairs prudently?
  • Can they follow all statutory requirements?

 

Many people prefer to appoint a trustee company to manage their affairs, removing any potential bias and ensuring statutory requirements are met.
